This time last year my superannuation fund took a hit - Sure, I'm *nowhere near* being able to access it as I'm not old enough, although watching it tumble downwards was disconcerting nonetheless. Fortunately the backslide slowed then reversed and it's looking much healthier right now which is great. Usually I don't spend much time looking at it but a letter last week brought it to my attention *in a good way.* 

Several years ago I swapped out of a superfund owned by one of the *big four* banks into something with lesser fees and charges and strong growth - The previous fund seemed more intent on raping and pillaging my money so I swapped out my super funds and insurances, life and permanent disability, away and elsewhere. I thought that was the end of it but about a year ago I found out there was more to the story.

As it turns out the *Australian Securities and Investments Commission* [ASIC] conducted a *review*, let's call it what it is though, an *investigation,* into six of Australia's largest financial institutions in respect of clients having not received services they had paid for. 

ASIC is a government commission that acts as a regulator of company and financial services and to enforce laws to protect consumers, creditors and investors - They carry a lot of weight and if fault is found and the hammer has to drop it drops hard.

In my case it was found that my superfund were paying *adviser service fees* to my financial adviser, who I also fired several years ago, without my knowledge and permission *and without me receiving those services.* The funds were being paid as *fees* from my account without being identified or specified as *adviser service fees.* Thousands were in the same situation and fortunately someone blew the whistle.

Over the last year or so I've had many letters from the bank that owns the superfund keeping me apprised of the investigation and even had several phone interviews in respect of the adviser and what he was or wasn't telling me. Those phone interviews were easy for me as I had received no services and had no meetings with the adviser.

The last call was to tell me that I was *not affected by the mistake* and I figured that was the end of it...Until last weeks letter. 

It turns out the bank was ordered to refund me the sum of $2,773.84 that was *"mistakenly paid to my adviser for services not received"* directly from my superfund. I read the 7 page letter a couple of times as I didn't believe what I was seeing but at the end it was true, I was refunded that amount. 

Because it is superannuation money and I'm not able to claim it through not being old enough under law the fund created a temporary superannuation account for me and placed it there - They had to do that as I had left them a few years ago remember?

Today I went online at my existing superfund and via the manual rollover tool advised my fund to claim my refund from the other fund and roll it into my existing one. Free money, that was mine in the first place.

I know I'm talking about small numbers here but I'm calling it a win. Corporations and financial institutions take advantage of the *little guy or gal* with impunity and mostly we have zero clue it's happening, as with my case and thousands of others also. To get a little back means a great deal. 

I don't know what that $2,773.84 will do for me as far as growth in the years to come but I'd rather have it in my pocket then leave it in theirs. Have you ever had similar happen?

That’s awesome man! Let’s take every penny we can from the crooks lol. I haven’t had a similar situation but I have taken a look at my accounts for retirement stuff and when I saw the assets that were allocated to all garbage risky stuff, I immediately spent time permanently reallocating it and adjusting any future investments to go into said strategy. I lost a few thousand by not paying attention to it, I might have gained it back after things rebounded but I was annoyed that they assumed I wanted it allocated that way. Now the portfolio is nicely diversified into some stuff and it’s a lot more stable so I feel like I haven’t lost as much money as others have who just let them decide. 

Don’t even get me started on the fees either lol. I’m handing them my money and get charge me fees to use it. What the shit?

Jotting down refunderisation for my dictionary of words that need to exist because they are relevant!

It's good to do what you've done, and a little *investimigationing* now may pay huge dividends later. [Another new word for your dictionary.]

So many funds do what they do with impunity simply because the customer doesn't know better. You're young enough that any potential loss, *or failure to gain* will be picked up as time goes by so well done for taking some initiative!

Good to see the refunded the fees - did they also have to pay compensation - i.e. the return you would have made on the fees if they were in your account rather than paid as fees? I was quite lucky early in my career to do some work for the industry super funds so I got a good education on the importance of super in general and the differences between the retail funds and the industry funds - as they say when you compare the pair you can certainly see the differences.

I was lucky to get the funds back for sure. There was some interest paid but no breakdown of refund and interest components. My *adviser* was more interested in getting commissions than my best interests and so I was in the wrong fund and paid the price. My current fund seems to be performing well; There's still fees but it's not too bad. 

It's really interesting to see the difference between funds and quite important to know their strategy and where they invest I think. I'm no expert but put some effort into learning those things.

This is not exactly the same, but in the neighborhood of banks and money.  My Dad was the kind of person that kept up with his personal business detailed down to the penny.  When he and Mom bought their last house 45'ish years ago, he had detail of the expected payments and time it would be paid off and all of that and he wrote it down.  He passed in 1997 and the house still had a few years of payments left.  When it came close to the time it should be completely paid for, it was found that the records showed there was an extra year of payments due, even though nothing had been altered or borrowed or short paid along.

In the research to try to find their error, it was found that about every few years or so, their loans had been bought and sold many times in the background.  They were unaware as it was seamless on the surface. What this caused, was there to be no true trail back to the beginning as each institution only had to keep their records a certain number of years and so conveniently, after a while, the trail just dropped off .....

The proof was long gone and in the end nothing was able to be done to correct it, so she paid an extra year worth of payments than she should have had too.

The banking industry has many shady pieces, some of which are very corrupt.

Glad you got your money back.  Although you say it is not so much, we never know the situation of our future days.  At some point, that amount of money could make a huge difference.

Yep, it's stories like that one hears now and then and just shakes the head. Banks. 

We don't really know what's going on to be honest and the *experts* who say they do are probably just as clueless in the grand scheme of it. People punch numbers with no real clue why or the implications of it and so most bank employees don't understand what they are actually doing to people. *Process this pile of work* they get told, so they do. 

Someone at the very top must know I guess...But for the little people. Clueless. I'm glad I had a little win though.

Makes me wonder how many other fees have been siphoned out of my bank accounts over the years... congrats on getting your thousands back, that's a lot.

I think this sort of thing probably goes on all the time without our knowledge; A little bit here and there, small amounts that we don't miss...And the corporation's make billions. 

It was a small win, gaining that money back, and having the bank admit to their behaviour publicly.
