the weed smoking is a non-issue from my perspective..

a) it's legal 
b) who cares

but the problematic part is he tests his employees for pot smoking and fires them but smokes himself

Yeah that is a problem. I just wrote about drug tests the other day, speaking of. I always say that employment should be based on merit. I would rather work with someone who is always high but who knows what to do than someone who is sober but incompetent.
