Una nueva edición de Tips de calidad, un nuevo tema que me gustaría tratar y que a pesar de estar en esta década donde todo parece estar en camino hacia lo digital, siguen existiendo malas prácticas y aunque ser creadores de contenido es algo a lo que muchos se dedican y quieren dedicarse, mucha gente sigue plagiando y robando contenidos, apropiándose de lo ajeno e insinuando ser talentosos a cuenta del trabajo de otros.

Pensaba que llegaría un punto donde esto se terminaría, pero supongo que mientras más personas lleguen a nuestra comunidad, más van a estar acarreando esas malas prácticas, y como siempre he dicho y reafirmo, los humanos actuamos bajo sanción y recompensa, mientras plagiar deje beneficios y tenga tan pocas sanciones, será una práctica común.

A pesar de las repetitivas charlas y advertencias que se hacen a diario, y de contar con esta pseudo-policía de los Downvotes llamada Hivewatchers, en #Hive no estamos exentos de plagio, copias y apropiación de contenido. Me gustaría decir que esto solo ocurre con los nuevos, pero hay hasta testigos y personas con más de 5 años en la plataforma que aún tienen estas malas prácticas y a la que muchas veces no se les dice nada solo por ser referentes o líderes de comunidad.

Es tan absurdo el tema en la plataforma que solo explica el hecho de que muchas personas, ni siquiera, entienden el concepto de plagio y como funciona, es por eso que le llaman plagio a cualquier tontería y cometen plagio sin darse cuenta de que lo es. Entender la definición de las cosas, nos ayuda a poder definirlas adecuadamente cuando se presentan ante nosotros y en el caso del contenido, saber cuando estamos por cometer un delito y como proteger nuestro contenido.

En muchos lugares del mundo también se le conoce a los secuestros como Plagio, y aunque parece no tener relación, esto se basa en que durante este, los delincuentes se apropian de la libertad de un individuo; Plagiar no es más que apropiarse de la totalidad o parte de una obra, haciéndola pasar por nuestra y obviamente no haciendo el correcto reconocimiento al verdadero autor de la misma. 

Debido a que este tema puede aplicarse a todo aquello que pueda ser registrado, y que dependiendo de la licencia de uso, el definir el plagio muchas veces es transitar sobre una delgada línea, donde la gran mayoría invita al uso del sentido común. Ya sea una imagen, frase, danza, estudio, video o un fragmento musical, partamos desde la premisa de que toda obra que no sea tuya es creada por otro y ese otro merece cuanto menos el reconocimiento por dicha obra sobre la cual tú deseas crear contenido.

Suele hacerme gracia que bajo la premisa de no ser estrictos, a veces solemos ser permisivos con el plagio y en ocasiones algunos tienen el descaro de alegar que solo hacen un poco de dinero mientras otros hacen millones. Para ejemplificar, Lego por su set de Vincent van Gogh - The Starry Night tuvo que pagar una licencia de precio reservado para poder poner a la venta este juguete de colección, si un museo o exposición desea mostrar esta obra o una representación de la misma debe pagar también una licencia, sin embargo, no somos estrictos y en #Hive, Youtube, TikTok, 3Speak y otras plataformas es fácil encontrar contenido de The Starry Night, percibiendo ganancia por dicho contenido y sin pagar una licencia, incluso si tu maquillaje, tu arte con acuarelas o animación digital mencionas esta inspirada en la obra original, déjame decirte que eso también es plagio, ya que estás percibiendo ganancia por dicha inspiración.

No hay buen plagio, incluso si es a modo tributo, incluso si lo utilizas sin fines de lucro, incluso si consideras que le darás una mejora al contenido original, no existe el buen plagio y en muchas ocasiones no solo basta con reconocer la fuente, como creadores de contenido debes pensar siempre en el respeto a otros creadores y en el reconocimiento que tú crees merecer y debes ofrecer a otros. Revisar los derechos de autor, reconocer correctamente a los autores originales o dueños de los derechos y emplear el contenido de forma respetuosa son los primeros pasos para mejorar tu calidad de contenido, y evitar el plagio, un mal tan dañino.

Basándonos en lo antes mencionado, la gran mayoría en desconocimiento y algunos con alevosía, hemos pecado de haber cometido plagio al menos en una ocasión, ya sea en esta plataforma o en alguna otra. Si eres de esos que niega esta afirmación déjame presentarte otra clase de plagio, el conocido Auto-plagio, otra práctica que aunque menos dañina, es rechazada por muchos.

Definir el auto-plagio es mucho más sencillo, consiste simplemente en tomar contenido propio y antiguo, y presentarlo una vez más como algo nuevo. Vamos, lo que te dice la TV cada vez que anuncia como estreno una película de 2002, tomar canciones antiguas y versionarlas o coger ese poema que escribiste hace años y publicarlo como nuevo.

Si bien esta no es una práctica que se suela sancionar en las más populares plataformas como Youtube, Tiktok, u otras, en #Hive y 3S muchos usuarios la condenan, más que por ser una mala práctica, esto tiene una connotación histórica de usuarios repitiendo contenido en Hive y en Steemit o Weku, transmitiendo en Dlive y Mixer o Youtube a la vez, entre otros. Luego llego la época de los votos automáticos y al no ~~querer~~ poder controlar estos, se prohibió otra práctica que era la de publicar el mismo contenido en distintos idiomas para evitar el farmeo de recompensas.

No está demás decir que por el funcionamiento de la plataforma donde existen reglas fijas y luego reglas de comunidades y luego reglamente de usuarios, el auto-plagio es una práctica que si no tiene un sentido, es considerado algo negativo para otros y prefieren sancionar, denunciar y atacar, que acogerse a su derecho de no recompensar dicho contenido. Contenidos como el de @hivebuzz quien usa múltiples cuentas para transmitir información en varios idiomas, es considerado auto-plagio y al tener un sentido, ser beneficioso para los usuarios y no ser con intención de cosechar recompensas, que alguien me diga ¿Cómo esto es negativo siempre?

Mi consejo en este apartado, pasa por la premisa de entender la plataforma en la que estas, ya sea entender las directrices de Twitch y Youtube, o entender a @hivewatchers, que puede no le digan nada a @roelandp si usa una imagen de Stock sin colocar la fuente, pero que si te van a sancionar si alguien denuncia tu contenido. Respetar las reglas de cada comunidad y pensar con cabeza el contenido que publicas es vital para evitar sanciones, incluso si el contenido es propio y lo publicas en múltiples plataformas más no en simultáneo, algunos pueden considerarlo auto-plagio.

A menos que tengas el suficiente capital para invertir, ponerte en contra de comunidades, ballenas y directivos, o entrar en un debate legal (En el caso de Hive y 3S una práctica imposible), y lejos de querer incentivar al auto-plagio, mi recomendación es que veas lo que hace Mr.Beast en Youtube o el ya mencionado HiveBuzz, que el contenido que publiques tenga sentido, ya sea una mejora al contenido anterior empleando este de base, teniendo múltiples cuentas para alcanzar varias comunidades, no insinuar novedad en la repetición y por supuesto nunca utilizar esto con la intención de ganar más recompensas o múltiples recompensas.

Antes de este post ya habíamos hablado también de los [derechos de autor](https://peakd.com/hive-148441/@jossduarte/tips-de-calidad-2-derechos-de-autor), pues si bien es sumamente importante conocer como evitar el plagio y la copia de contenido, también me parece sumamente necesario que como creadores podamos conocer que nos protege a nosotros y nuestro contenido de estas malas prácticas.

Como diseñador gráfico algo que suelo hacer y recomiendo a mis clientes es registrar las marcas que hago, y suelo tener un archivo de texto en mi computador donde cedo los derechos de las obras digitales que entrego a mis clientes, que aunque no sea un documento formal, sirve para la realización de un registro y como prueba de una cesión de derechos. Todo esto como una medida de protección para mis clientes y para mí, pues si bien hoy su valor no sea excesivo, nadie sabe en qué momento pueda despegar como lo hicieron las obras NFT por dar un ejemplo.

### 3. Registro de Obra

En principio el apartado de registro iba a tener un post completo, pero tras investigar bastante, los distintos países de Latinoamérica, estados unidos y la unión Europea suelen tener requisitos de registro diferentes, por lo que un post sería extremadamente largo y quizás no se adapte a cada uno de los países desde los que puedan estarme leyendo. Más, hay varios factores que se repiten y que vale la pena destacar a la hora de registrar nuestras obras.

Como ya dije, puede que tus obras hoy no las consideres de valor y te preocupe poco si alguien las utiliza, pero registrar dichas obras es un acto de respeto hacia ti como artista y un proceso que te brinda un respaldo a futuro. También es importante saber que podemos registrar y que no, y para esto, aunque lo ideal sería una consulta legal con un especialista, todos los países que consulte tienen una institución gubernamental de derechos de autor en la cual te pueden brindar asesoría.

En la mayoría de lugares suelen pedir requisitos como copias de aquello que vas a registrar, un testigo, pruebas de la elaboración y documentos legales de quien registra la obra como suya, en algunos países suelen pedir una suma de dinero mientras en otros es totalmente gratis.

En cuanto a registro, plataformas como TikTok, Twitch, Facebook y Youtube tienen un apartado legal para asesorarte y proteger tu contenido, aunque no es el mejor, es mucho más que no tener nada; La asesoría y el respaldo legal, deben ser parte fundamental de tu inversión como creador de contenido, que grandes empresas y personalidades recurran siempre a sus abogados, no es simple pretensión, sino un acto de protección.

Podremos registrar toda obra literaria, artística, auditiva, gráfica entre otras, que sea de nuestra propiedad, obras cinematográficas, coreográficas, fotográficas y más. También podrás registrar traducciones, arreglos, resúmenes y actualizaciones de trabajos, siempre y cuando estas no vulneren los derechos de autor de otros y por supuesto siempre que puedas probar que la obra a registrar te pertenece o tienes los derechos sobre ella.

En cuanto a lo que no podremos registrar, es todo aquello que implique algo ya existente, por ejemplo, no puedes registrar una palabra de un idioma ya existente a menos que esta se considere parte importante de una marca u obra. Del mismo modo, tampoco puedes registrar, fórmulas y algoritmos, patentes, tutoriales, procedimientos para hacer, realizar o construir algo, descubrimientos científicos o técnicos, estilos artísticos, métodos, proyectos e ideas. Es por esto que dependiendo de tu región lo mejor sea asesorarte para saber cuanto de tu contenido puede ser registrado y bajo que autoridad.

Si bien el proceso de descentralización no me parece negativo, cuando los lineamientos o reglas se van construyendo sobre la marcha, dependen de la opinión y no se basan en la estructura de la sociedad, sin tener en cuenta las amplias diferencias que tienen las personas como individuos, lo que para algunos es plagio para otros no, lo que para algunos es uso editorial para otros no y aunque todos tenemos la oportunidad, a quien se le ha dado la confianza de sancionar y vigilar es a un grupo, que aunque no me pare mal, marca que sea también quienes impongan la línea legal a transitar.

De este post puedo resumir la importancia del conocimiento y asesoría legal, tanto para evitar el acometimiento de un delito, como para blindar nuestro contenido, también la importancia de que todo el contenido que creemos respete las condiciones legales impuestas tanto para el plagio como para los derechos de autor y por último la importancia de leer los términos y condiciones, conocer la plataforma donde vamos a crear contenido y entender sobre que suelo vamos a transitar. 

El plagio no es bueno, no ha sido y no será positivo, evitarlo está en nuestras manos tanto produciendo un contenido de calidad que respete a otros, como registrando nuestro contenido para que otros se vean obligados a reconocernos. Dile no al plagio, dile si al valor de tu contenido y a la creación consciente.
