Today's pending ruling from the SEC/CFTC on whether or not Ethereum is defined as a "Security" is going to have a big impact on the space one way or another.

If ETH is deemed a security, then under U.S. federal law it should have been registered with the U.S. Securities and Exchange Commission (SEC) back in 2014 before being offered to US investors.  (I think this is the major reason EOS is not "offered" in the US via block.one and must be gotten off an exchange.)  How they are going to "punish" those involved will give us a good indication of how the government plans on ruling from up above in the future.  

The SEC is also looking into whether or not the Ethereum Foundation continues to wield a large amount of influence over the coin’s value.  I think this is were Vitalik is going to have a hard time arguing no and where he is ultimately most vulnerable.  

Former U.S. government regulator Gary Gensler told the WSJ [Here](https://www.wsj.com/articles/worlds-second-most-valuable-cryptocurrency-under-regulatory-scrutiny-1525167000?ns=prod/accounts-wsj)  that: 

> “there is no legal precedent” for ETH. In a speech last week, Gensler said that “there is a strong case” ETH could be a “noncompliant” security – meaning unregistered with the SEC. 

I have a feeling the power hungry sociopaths in Washington/New York are not going to be able to help themselves from inserting their grip into this space to "protect people from themselves".  This will ultimately hurt innovation in the short run but an argument can be made for adding an air of legitimacy to the space in the eyes of some...at least that is how they always sell it.  These are the same benevolent overloads that brought us Mortage Backed Securities and financial Derivatives. 

Ultimately, though, this could benefit coins like EOS the most.  Having avoided the USSA and China altogether may have been the smartest decision they could have made and may be why its the only coin in the top 10 up on the day.
