### ChatGPT First Defamation Case
An Australian Mayor of a regional town is about to set a new legal precedent in the battle between AI powered information and defamation which has been on the *what it* pile for many legal teams, policy makers and the community alike. 

Coliban Ward Councillor and current Mayor, [Brian Hood](https://www.hepburn.vic.gov.au/Council/About-Council/Councillors) is considering suing ChatGPT for an incorrect response to questions asked about the Councillor. The ChatGPT AI's responses put Councillor Hood as a guilty party to a bribery scandal in the 2000's. 

Should the Councillor commence legal proceedings against ChatGPT he will be heading into unchartered legal waters as the technology is still relatively new and the question needs to be asked, can the company who owns the bot be liable for the information distributed by the bot and what are the ramifications of those actions?

In 2009 an investigation commenced in one that the now Mayor [blew the whistle ](https://www.abc.net.au/news/2012-10-08/stevens-reflects-on-handling-of-note-printing-scandal/4301496) on what allegedly involved Note Printing Australia and Securency in bribing public officials in Malaysia, Vietnam, Indonesia and Nepal to obtain banknote printing contracts. 

The case was handled in secrecy behind closed doors with much of it unknown until 2018 with offences commenced in 1999 and 2004 and saw many of the top executives [jailed and record fines for the companies involved](https://www.abc.net.au/news/2018-11-28/rba-subsidiaries-securency-note-printing-record-fines-bribery/10561542). Even the Reserve Bank of Australia making comment on it's [regret of the handling of the situation.](https://www.abc.net.au/news/2012-10-08/stevens-reflects-on-handling-of-note-printing-scandal/4301496)

### ChatGPT get's the case wrong 
In what can only be described as a monumental failure of an AI and serves as a start warning of how AI can get things wrong the AI puts Cr Hood in the middle of the corruption scandal even going as far as claiming he was found guilty of conspiracy and sentenced to 30 months jail. 

This is what has caused significant distress to Cr Hood as was the whistle blower who became the [prosecution witness ](https://www.abc.net.au/news/2023-04-06/hepburn-mayor-flags-legal-action-over-false-chatgpt-claims/102195610) and is extremely distressed with what has occurred and recently commenced legal proceedings issuing a concerns notice which is the first step in commencing defamation cases. 

Whether or not a human can sue a bot is yet to be determined and the complexity of the issues surrounding where the company is located and current laws is yet to be explored.

AI is open bot and is still learning and initial study phase and should be spared and development engineer should be warned about it and do some fixing to change the previous output....

They have warnings on the site to not rely on the veracity of the information ChatGPT provides:

The question is: May the AI or its trainers hide behind those disclaimers to spread false information / manipulate etc.? Interesting times are coming...

AI is bound to get things wrong and I honestly don't know if it will pass the sniff test at all. I know that there are issues but I wonder where the articles/sites that ChatGPT got that information and then decided on that summary. It could be those sources that causes the issue.

Part of me thinks that the chatbot should be excused because it's far from perfect and only beginning its development but the other part thinks getting the facts wrong in which one's reputation is put into question will be hard to let it slide. I hope they're able to work things out rather than suing the chatbot.
