Gestern sind weitere Details zur neuen Besteuerung von Kryptowährungen in Österreich durchgesickert. Es gibt anscheinend bereits einen Gesetzesentwurf.

Wenn es um die Erhöhung von Steuern geht, arbeitet die Regierung plötzlich ungewohnt schnell. Fast schon überfallsartig, denn der neue Entwurf soll rückwirkend (!) gelten. Dazu gleich mehr.

Die wichtigsten Änderungen einfach zusammengefasst sind, dass die Haltefrist-Regelung komplett gestrichen wird. Anders als zuvor spekuliert, wird die Haltefrist quasi auf unendlich wie bei Wertpapieren ausgedehnt. Das heißt, dass man auch nach 100 Jahren Steuern auf so lange gehaltene Kryptos zahlen muss, ohne die Inflation oder ein mögliches Hyperinflations-Szenario zu berücksichtigen.

Die nächste wichtige Änderung ist, dass Spekulationsgewinne aus Kryptos nicht mehr unter die Einkommensteuer, sondern unter die Kapitalertragsteuer fallen (27,5%).

Die Regelung soll bereits rückwirkend (!) mit Stichtag 28. Februar 2021 gelten, d.h. alle Krypto-Assets die heuer ab März angeschafft wurden, würden bereits unter die neue Regelung fallen. Das ist schon eine kleine Frechheit meiner Meinung nach.

Aber es gibt auch etwas Positives, der Tausch zwischen Kryptowährungen soll nicht mehr unmittelbar besteuert werden, sondern erst dann, wenn man in Euro wechselt. Das macht Sinn. Man erspart sich dadurch keine Steuern, aber es wird der Dokumentationsaufwand massiv erleichtert und die Steuer fällt erst dann an, wenn man auscasht. Also das finde ich eine faire und praktikable Lösung.

Was sagt ihr zum neuen Steuer-Entwurf in Österreich? Bleibt Österreich damit krypto-freundlich oder ist der Wegfall der Haltefrist ohne die Inflation zu berücksichtigen Diebstahl?

Yesterday, more details about the new taxation of cryptocurrencies in Austria were leaked. Apparently, there is already a draft law.

When it comes to raising taxes, the government suddenly works unusally fast. Almost ambush-like, because the new draft is supposed to apply retroactively (!). More on that in a moment.

The most important changes, simply summarized, are that the holding period rule (tax exemption) will be completely eliminated. Contrary to previous speculation, the holding period will be extended to infinity, as it is for securities right now. This means that even after 100 years, one will have to pay taxes on crypto profits held for such a long time, without taking into account inflation or possible hyperinflation scenarios.

The next important change is that speculative gains from cryptos will no longer be subject to income tax, but to capital gains tax (27.5% in Austria).

The regulation is to apply retroactively (!) as of February 28th, 2021, i.e. all crypto assets acquired this year as of March would already fall under the new regulation. This is a little cheek in my opinion.

But there is also something positive, the swapping between cryptocurrencies should no longer be taxed immediately, but only when you exchange into Euro. That makes sense. It doesn't save you any taxes, but it massively eases the documentation burden and the tax only comes into play when you cash out. So I think that's a fair and workable solution.
