Während der Biden-Regierung wollte sich der damalige SEC-Vorsitzende Gary Gensler außer bei Bitcoin (ist ein Commodity-Gut) nie konkret festlegen.

Die Einstufung hat einige signifikante Auswirkungen, vor allem was den Handel der Kryptowährungen betrifft. Wäre eine Kryptowährung tatsächlich ein Wertpapier, würde es viel schwieriger sein, damit Handel zu betreiben. Das würde Krypto-Börsen in Bedrängnis versetzen, sich der SEC-Aufsicht zu unterwerfen, sich um SEC-Lizenzen bewerben zu müssen, noch mehr Regulierungen zu befolgen etc. Auch die Firmen und Startups, die Kryptoprojekte betreiben, würden in Schwierigkeiten gelangen. Im Endeffekt würde der regulatorische Aufwand explodieren. Für viele FinTech-Startups (auch für hive) wäre das ein totaler Overkill.

Die jetzige Einstufung von Ethereum schafft nicht nur Klarheit, sondern deutet auch auf einen kryptofreundlicheren Kurs der Trump-Administration hin, und hat auch Auswirkungen auf andere Kryptowährungen, die jetzt auch eher nicht als Security eingestuft werden, wobei die SEC sicherlich jedes Projekt im Detail begutachten wird.

Dass die SEC den Kryptobörsen und der FinTech-Branche große Steine in den Weg legen wird, ist mit dieser Entscheidung unwahrscheinlicher geworden. Erfreuliche Entwicklung.

The new SEC chief Paul Atkins has now finally confirmed that even the proof-of-stake-based Ethereum (ETH) is not a security.

During the Biden administration, the then SEC chairman Gary Gensler never wanted to commit himself specifically on the status of cryptocurrencies, except in the case of Bitcoin (which was declared a commodity).

The classification has some significant implications, especially with regard to cryptocurrency trading. If a cryptocurrency were actually a security, it would be much more difficult to trade it. This would put crypto exchanges in a difficult position, forcing them to submit to SEC oversight, apply for SEC licenses, comply with even more regulations, etc. Companies and startups operating crypto projects would also find themselves in trouble. Ultimately, the regulatory burden would explode. For many FinTech startups (including hive), this would be total overkill.
