SEC chair Gensler was asked in Congress whether Ethereum is a security or not, even the SEC does not know how Ethereum is regulated 😂
Der Vorsitzende der SEC Gary Gensler wurde im Kongress von Patrick McHenry (Rep) gefragt, ob Ethereum ein Wertpapier ist oder nicht, bekam aber keine konkrete Antwort 😂

Gensler antwortet wie ein Politiker. Er weicht der Frage ständig aus und möchte sich nicht festlegen.

Wenn nicht einmal die Regulierungsbehörde sagen kann, ob Ethereum ein Wertpapier ist, wer dann 😂 Niemand weiß genau, was es regulatorisch ist. Ein Commodity (Rohstoff), eine Währung oder ein Wertpapier?

Die Position der SEC war zuletzt verstärkt gegen Kryptowährungen vorzugehen und alles außer Bitcoin als Wertpapier zu sehen. Das hätte enorme regulatorische Auswirkungen. Ether könnte man dann nicht mehr an Krypto-Börsen (ohne SEC-Lizenz) handeln etc.

Die Ansicht der SEC ist in etwa, wenn eine Kryptowährung eine Firma oder Foundation im Hintergrund hat und Zinsen auszahlt (zum Beispiel bei Proof of Stake) ist es ein Wertpapier.

Nur wirklich dezentrale Kryptowährungen wie Bitcoin fallen nicht darunter.

Wäre auch interessant, wie die SEC Hive sehen würde, da es seit dem Steem-Fork keine offizielle Firma mehr gibt, sondern eine DAO. Andererseits handelt es sich wiederum um eine Proof of Stake Blockchain, die Zinsen auszahlt.

Wird spannend, wie sich das alles regulatorisch entwickeln wird. Denke nach den Aussagen von Gensler, dass die USA Krypto doch nicht völlig abwürgen wollen. Die USA möchte wahrscheinlich ihre Krypto-Vorreiterrolle nicht an andere Länder verlieren, denke ich.

SEC Chairman Gary Gensler was asked in Congress by Patrick McHenry (Rep) if Ethereum is a security or not, but did not get a specific answer 😂

Gensler answers like a politician. He keeps dodging the question and doesn't want to commit.

If not even the regulator can say if Ethereum is a security, who can 😂 No one knows exactly what it is regulatory wise. A commodity, a currency, or a security?

The SEC's position recently has been to crack down more on cryptocurrencies and see everything but Bitcoin as a security. That would have huge regulatory implications. Ether could then no longer be traded on crypto exchanges (without an SEC license), etc.

The SEC's view is roughly, if a cryptocurrency has a company or foundation behind it and pays out interest (for example, with Proof of Stake) it is a security.

Only truly decentralized cryptocurrencies like Bitcoin do not fall under this.

Would also be interesting to see how the SEC would view Hive, since there is no longer an official company since the Steem fork, but a DAO. On the other hand, it is again a proof of stake blockchain that pays out interest.

Will be exciting to see how this all plays out regulatory wise. Think that after Gensler's statements that the US doesn't want to completely stifle crypto after all. The US probably doesn't want to lose its crypto edge to other countries, I guess.

Denke auch, dass die **USA** das Potential von Crypto & Blockchain sehen und es nicht abwürgen wollen. Aber reguliert werden sollte es schon um es der breiten Masse und vor allem den Institutionellen zu ermöglichen möglichst „sicher“ zu investieren.
Was **Ethereum** angeht, denke schon da es eher ein Wertpapier denn ein Rohstoff ist. Genau wie das meiste außer Bitcoin. Es ist jeweils eine Gruppe an Gründern dahinter oder Investoren/VC die einen relevanten Anteil der Coins/Token halten und man kauft sich dort sozusagen einen Anteil/Exposure an dem Projekt. 
Ist zB. bei **Hive** ähnlich, zumindest mal was die Token angeht. SPS zB. sind für mich sowas wie Splinterlands Aktien. Wenn das Game und das Team dahinter Erfolg haben wird SPS steigen und umgekehrt.

Vielleicht wird es einmal eine eigene Kategorie für Governance-Tokens und Proof of Stake Kryptos geben, irgendwie passt das Aktienrecht auch nicht ganz, da es sich ja meistens um sehr kleine Startups handelt. Da wäre die Regulierung als Wertpapier oder Aktie ein totaler Overkill meiner Meinung nach und das weiß die SEC vermutlich auch.

Das mag sein, dass man zB. ein mindest Market Cap wie zB. 50 Mio erreichen muss um unter die Regulierung zu fallen. Aber grundsätzlich passt Wertpapier schon recht gut auf die allermeisten Kryptos.

Danke für die Info, interessanter Thread, Hive würde dann vermutlich auch als Security eingestuft, aber irgendwie passt es auch nicht ganz. Das Problem ist der regulatorische Overhead, den so eine Bewertung nach sich ziehen würde. Das wäre für viele Krypto-Projekte ein totaler Overkill.

Ganz sicher ist man vor diesen Typen nicht im Kryptospace. Aber als weitgehender Bitcoin-Maximalist bin ich auf der sicheren Seite. Julian Hosp erzählt ja ständig, dass er einen Wechsel an der Tabellenspitze kommen sieht. Ich bin da mehr bei Roman Reher (Blocktrainer). 
Alles, was ich außer Bitcoin halte, ist Beiwerk. Und ich bin ein Hodler; ich akkumuliere, bis ich mir ein Haus kaufen kann ohne Kreditaufnahme. Am liebsten würde ich dann das Haus mit Bitcoin bezahlen.

Hive ist glücklicherweise unterhalb des Radarschirms der Regulatoren. Eher werden die Zensoren auf Hive aufmerksam, weil sie hier nicht dazwischenfunken können. 
Ich tummle mich auf dieser Plttform, weil es Spaß macht zu bloggen und interessante Atrikel von kompetenten Menschen zu lesen und zu kommentieren.

Gensler has made statements saying that everything except BTC is a security but I don't think that is the case. I just don't like how the regulations are intentionally left vague so they can go after whatever they feel like

Ja am interessantesten finde ich die Einschätzung von Hive. Dezentral, Zinsen werden gezahlt. Alles funktioniert. Da bin ich gespannt wie man das regulieren kann. Wird wohl noch einige Jahre dauern.
