## Intro.
안녕하세요! inverse입니다. 한승희 국세청장 후보자가 오늘 비트코인을 ‘양도소득세 과세대상으로 검토’하겠다고 말했습니다. 저는 이에 찬성합니다.
비트코인 과세에 있어서 고려할 점은 부가가치세(VAT)와 소득세입니다. 부가가치세는 물건을 사고 팔 때 10%의 세금을 내는 것입니다. 한편, 소득세는 비트코인을 들고 있다가 가격이 올라서 판매할 때 그 차익에 대해서 세금을 내는 것을 말합니다.
우선 다양한 국가들의 가상화폐 과세에 대한 입장 및 현황을 간단하게 살펴보겠습니다.
## 1. 우리나라
현재 양도소득세 과세대상은 **부동산, 부동산에 관한 권리, 주식 등, 영업권 등 기타자산, 파생상품**입니다. 아직까지 우리나라에서 비트코인은 부가가치세 과세대상도 아니며 (양도)소득세 과세대상도 아닙니다.
## 2. 미국
의회에서 가상화폐 거래에 관한 국세청(IRS)의 과세 가이드라인을 촉구하였습니다. 미 국세청은 이미 가상화폐 과세 가이던스를 제시했지만 가상화폐를 활용하는 업계에게는 아직 더 구체적인 과세 가이드라인이 필요한 상황입니다. 현재로서는 규제당국이 유심히 지켜보기만 하고 있습니다. 외환거래처럼 일정 금액 이상의 거래는 보고하도록 규제하고 있습니다. 이를 두고 비트코인을 외환으로 보는 것이냐? 하는 지적도 있습니다. 하지만 앞으로 어떤 방식으로, 얼마를 과세할지 확정되지 않은 상태이기 때문에 불확실성이 큽니다.
* Perry Woodin(CEO of Blockchain development company Node40)은 IRS가 거래를 추적할 수 있는 특정 소프트웨어를 사용할 가능성이 있다고 말했습니다.
## 3. 일본
7월부터 비트코인을 소비세 과세대상에서 제외시켜 이중과세 문제를 제거했습니다. **자산이 아니라 화폐라고 인정**한 대표적인 사례입니다.
* 소비세(우리나라의 부가가치세)가 이중과세인 이유: 비트코인을 100만원에 사서, 비트코인으로 냉장고를 사는 상황을 가정해봅시다. 냉장고를 사는 거래에서 소비세를 내는데, 비트코인을 살 때도 세금을 내야하기 때문에 이중과세라는 겁니다. 100만원으로 냉장고를 사는데 그 100만원에 또 과세를 하는 웃기는 상황이 생긴거죠. 즉, 화폐는 과세대상이 아닌데 비트코인을 화폐가 아니라고 규정했기 때문에 생기는 문제입니다.
## 4. 호주
기존에는 비트코인 거래에 대해서 과세를 했고 이중과세가 되었습니다. 그러자 코인 거래소가 싱가포르와 홍콩과 같은 친-가상화폐 국가로 도망가버렸고 결국 일본과 유사하게 비트코인을 화폐로 규정하고 올해 7월 1일부터 간접세 과세대상에서 제외시켰습니다.
## 5. 중국
자본유출 우려 때문에 비트코인 거래에 대해서 부정적입니다. 비트코인 거래를 부가가치세 과세 대상으로 규정했지만, 현재 모든 것이 불확실합니다. 개인은 거래를 할 수 있지만 은행 등 기관은 거래할 수 없습니다.
## 6. 결론
우리나라는 양도세를 이야기하네요. 비트코인으로 인한 자본이익이 생기면 과세하겠다는 겁니다. 제 사적인 의견을 보태자면, 비트코인은 화폐의 성격이 크기 때문에 이중과세 문제를 방지하기 위해서 일본처럼 부가가치세 과세 대상에서 제외 될 것이며, 양도소득세 과세는 무난하게 통과될 것 같습니다.
얼마 전 모건스탠리가 비트코인의 가치가 더 상승하기 위해선 정부의 규제가 필요하다고 주장했습니다.

정부가 가상화폐를 합법적인 자산으로 받아들이고, 적절한 규제가 있어야 가상화폐에 대한 신뢰도가 커져서 지금보다 훨씬 큰 판을 만들 수 있기 때문입니다. 저는 지금 우리나라가 적어도 비트코인에 관해서만큼은 적절한 시기에, 적절한 방향으로 가고 있다고 생각합니다. 어떤 방식으로 얼마나 양도소득세를 과세할지는 아직 모르지만, 지나친 수준이 아니라면 가상화폐의 본질적인 가치를 한층 더 끌어올리는 길이라고 생각합니다.
