Buenas noches mis queridos lectores de steemit, hoy les traigo la primera parte sobre el derecho laboral que tienen los trabajadores en Venezuela, debido a que muchos venezolanos desconoces sus deberes y derechos en el área laboral.
# Aspectos fundamentales
* Prestaciones y Antiguedad
* Jornada de trabajo
* Días feriados
* Estabilidad
# Prestación y antigüedad!
**Prestaciones Sociales (Prestación de Antigüedad) (artículos 141-146) y Premisas (Art. 141)**
* Recompensan la antigüedad en el servicio y los ampara en caso de cesantía.
* De forma proporcional al tiempo de servicio, calculado con el último salario devengado por el trabajador al finalizar la relación laboral.
* Son créditos laborales de exigibilidad inmediata. La mora en su pago genera intereses, los cuales constituyen deudas de valor y gozan de los mismos privilegios y garantías de la deuda principal.
**Prestaciones Sociales (Prestación de Antigüedad) (artículos 140-146), Garantía y cálculo (Art. 142 - 143)**
* 15 días de salario integral por trimestre, a título de garantía. El derecho se adquiere al iniciar cada trimestre.
2 días adicionales por cada año de servicio acumulativos hasta 30 días.
* Se depositan en fideicomiso, FNPS o en la contabilidad de la empresa con autorización del trabajador. Al finalizar la relación de trabajo se calcula con el último salario en base a 30 días por cada año de servicio o fracción superior a 6 meses.
* El trabajador recibirá la suma que resulte mayor entre lo depositado en garantía durante la relación de trabajo y el calculo retroactivo al finalizar la misma.
* Relación de trabajo que termina antes de primeros 3 meses: 5 días de salario por mes trabajado o fracción.
* Pago dentro de los 5 días siguientes a la terminación de la relación laboral.
* La mora causa intereses a la tasa activa determinada por el BCV.
* Pago de la garantía se hace atendiendo la voluntad expresa del trabajador:
* FNPS: Causará intereses al rendimiento del Fondo.
* Fideicomiso: Causará intereses al rendimiento de éstos. Contabilidad del patrono: Intereses a la tasa promedio entre la pasiva y la activa determinada por el BCV. Calculados mensualmente y pagados cada año, excepto que el trabajador los decida capitalizar. Si el patrono no cumple, paga intereses a la tasa activa determinada por el BCV. El Patrono debe informar detalladamente trimestralmente de los depósitos por prestación de antigüedad.
* Hasta de un 75% de lo depositado como garantía para: La construcción, adquisición, mejora o reparación de vivienda para él y su familia.
* La liberación de hipoteca o cualquier otro gravamen sobre vivienda de su propiedad;
* La inversión en educación para él, ella o su familia; y Los gastos por atención médica y hospitalaria para él, ella y su familia.
* Si está en su contabilidad, el patrono dará aval en caso de préstamo solicitado por el trabajador a una institución financiera, hasta por la totalidad de lo depositado en garantía.
* Si está en el FNPS o en fideicomiso, el trabajador podrá utilizar ese capital como garantía de prestamos.
**Fondo Nacional de Prestaciones Sociales (Art. 147): Particularidades**
La Ley especial determinará el régimen de creación, funcionamiento y supervisión del Fondo Nacional de Prestaciones Sociales.
# Jornada de trabajo.
Jornada de trabajo (artículos 167 y siguientes) Se entiende por jornada de trabajo, el tiempo durante el cual el trabajador o la trabajadora está a disposición para cumplir con las responsabilidades y tareas a su cargo.
• 5 días a la semana y derecho a 2 días de descanso continuos y remunerados durante cada semana de labor.
• Jornada diurna: De 5:00 a.m. y las 7:00 p.m. No podrá exceder de 8 horas diarias ni de 40 horas semanales.
• Jornada nocturna: Entre las 7:00 p.m. y las 5:00 a.m. no podrá exceder de 7 horas diarias ni de 35 horas semanales. Toda prolongación de la jornada nocturna en horario diurno se considerará como hora nocturna.
• Cuando la jornada comprenda períodos de trabajos diurnos y nocturnos se considera jornada mixta y no podrá exceder de las 7 1⁄2 horas diarias ni de 37 1⁄2 horas semanales. Cuando la jornada mixta tenga un período nocturno mayor de cuatro horas se considerará jornada nocturna en su totalidad.
# Estabilidad Laboral.
**Estabilidad (artículos 85 y siguientes)**
**GARANTÍA DE ESTABILIDAD:** Permanencia en su trabajo, si no hay causas que justifiquen la terminación de la relación laboral.
* Los trabajadores a tiempo indeterminado a partir del primer mes de prestación de servicio (Periodo de Prueba).
* Los contratados por tiempo determinado, mientras no haya vencido el término del contrato.
* Los trabajadores contratados para una obra determinada, hasta que haya concluido la totalidad de las tareas a ejecutarse por el trabajador para las cuales fue expresamente contratado.
**ÚNICA EXCEPCIÓN:** Los trabajadores de dirección.
3.- Si el trabajador acepta, es posible el despido injustificado indemnizando con un monto equivalente a lo que le corresponda por Prestación de Antigüedad.
4.- Causas justificadas de despido (Art. 79) y de retiro (Art. 80).
